Clayton Georgia - applicant filled out rental application on January 16th which specifically asked the question: do you have pet. applicant left security deposit. applicant is section 8. prior to signing the lease, applicant informed LL that she has a pet. under the law, is landlord required to refund deposit, bearing in mind that the unit was being held for applicant since January 16th and that landlord now needs to advertise this same unit again. applicant did not sign lease and did not disclose on application that she has a pet.

Actually what does it say in the lease? If it is stated in the lease NO PETS, then you have a right ot keep the deposit for damages.......

RULE #1 The Landlord is entitled BY LAW not to lose even ONE DAYS rent. so if no rent has been paid since the Jan 16th the security can be used to pay for it.

Why did you accept a security deposit without a lease?

That would have given you the answer to your question.
