From rentee in New York State.
Is there a advanced period of time needed for the landlord and rentee to have a lease renewal signed? Or is it contigent on what is stated in the original lease itself.
Our current lease does not state a time period for a lease renewal to be signed. Should it be 30 days before the lease ends?
The duplex that we are leasing has a sale pending on it. It was to be closed on the 15th of May, however there has been a delay on the mortgage approval, We as tenants have no guarantee that the rent will increase substantially with the new owners. The end of the lease is July 1. Do we as tenants have any say about getting a lease renewal signed by June 1 with the current landlord or do we have to wait for the new owners? We need time to pack and move if the new lease is unacceptable. What is our recourse in this matter?

With no guarenteed lease renewal, the landlord doesnot have to offer you one.

BUT you have a legal lease until July 1st.

So you do have a choice, you can give your 30 day notice and be out by July 1st. AND you would NOT be liable for any more rent since the lease had expired!...... or take your chances that the new onwer MAY and i stress MAY want to sign a new lease with you.

If you stay past July 1 and no one has given you a 30 day notice to vacate the premisis by JUNE 1st, then you become a month to month tenant at the same last rent.

And after the house closes, you must sue the NEW owner for your security deposit since it gets transferred at the closing, unless the present landlord gives it back to you.

If the house closes in june the worst the new owner can do is give you a 30 day notice to move OR a rent increase, BUT the 30 days does not start until your next rental period, SO you must be out or the rent increase takes efect on AUGUST 1st, and July's rent will be the same as junes rent
