I have an apartment in Vermont which I ret through an Agent/Broker. This apartment is normally rented as a seasonal rental for longer terms (months instead of weeks/days). I signed an agreement to rent the apartment from 1/1/2000 to 8/31/2000. The rent is due on the first of the month to the broker/agent. The first month's rent was not received until 1/25/00. The second's month rent was paid on time. The tenant has never occupied the apartment - he was supposed to use it several times during January/February but never showed. In late February/early March the tenant called the agent/broker asking for his security back as he was in a financial bind. The agent/broker told me not to return the security but the tenant's phone message seemed desparate - I told the agent/broker to return the money. As you could guess, the tenant has not paid the rent for March and repeated calls from the agent/broker to the tenant have not been returned. As this agreement is a legally binding contract and the tenant has obviously defaulted on this obligation, how should I proceed?
