Lease termination

What is the name of your state? CA

A tenant rents a room at my home. Before she moved in, she signed a month-to-month lease that is automatically renewed in the beginning of each month. In the lease, it is stated that one of us can end the lease by giving the other party 60 days notice.

She is very disrespectful and irresponsible and she has caused unnecessary stress in my life, therefore, I'd like to end the lease. But I'm wondering, would this be considered a discriminatory termination? Could she take me to court even though it's stated in the lease that either of us can end the lease with 60 days notice?

Another thing is, she has broken some appliances and refused to take responsibilities. Her excuse has always been, "this is not [my] home." She has just broken another appliance over the weekend. Can I legally make her pay for half of the repair?

sounds like based on the way you wrote the lease, you can terminate any time you want. just don't specify a reason. simply write in your notice that you have elected to not renew her lease as of xx/yy/zzz. period. end of story.

if she broke it through neglect or abuse, charge her the full cost to replace. just don't try and replace the cheapo GE range with a Dacor or a cheapo Hotpoint fridge with a Subzero, then charge the tenant for that.

because if she is that disrespectful to your property now just think how she is going to act once she gets your letter. Document everything she breaks and if possible have receipts for it all. Als be prepared not to get any rent for those last 2 months. I would be surprised if she paid it.

Take pictures of things she's broken, so you have proof of items broken if it has to go to court. Taking her to small claims court even after she's moved out can result in her paying for damages.

thank you all for the suggestions. I have given her a letter of termination. I hope I won't end up in a small claim court, but just in case, I am keeping a list of things she's breaking.
