My husband and I were in an apt. for aprox. 2 1/2 years. Upon the first lease water damage was sustained in every room with a window, peeling paint, water marks on ceiling, and a hole from the sheetrock being wet. None of wich was repaired during our occupancy, even with numerous letters. We put our notice in (30 day) siting these facts and our move out date. No reponce. (I had the letter signed by lease agent and dated) No notice was ever put on our door in the following 30 days. We were under the inpression that we signed a 6 month lease, but I have learned that it was a 1 year lease. They are trying to charge us a reletting fee as well as the the remainder of the rent. In the letter that
I had them sign I put in that our remaining rent that would be due was $220.00 for the partial month of Febuary 2001. Since they signed and accepted our notice..did not let us now about any other fees or anything else before we moved out (30 day) and they were in breach of contract because of the repairs that they had never done but assured us for almost 2 years. Are we still responsible? The also want to keep our $500 deposit. Charging us $1700. I can't see how they can get away with that. I sign my husbands name to the contract he did not sign.

Fees are not rent.
You owe fees plus rent until the unit is re-let.
If you have a signed agreement that the partial rent for the remainder of February is $220, then that is all that you owe for February.

How can you not know the length of your lease after you have signed it?
