I recently gave my 60 day notice to terminate my lease. This sixty days is up today. Two days ago the leasing manager wanted to know if I would be gone by this date. She is aware that I will be relocated after my new jobs calls for training. I am relocating to another property with the same mangagement company. It appers this is going to be delayed two or more weeks. I faxed her documentation of this change and stated in the letter i would be paying the entire month of September and would release control of the apatment as soon as I move. I will also be paying the termination fee.

Question: She requested this information in writing and I faxed it to the office. Two days ago. The lease actually states that holdovers will be charged double the lease prorated for each each day held over. Does the acceptance and lack of response from my letter constitute an agreement on this matter? Or should I address this matter more today?

Youd better get your butt over to the office right this minute and get it straighted out in writing!!!

Actually you should have done it yesterday...

With nothing else in writing a judge will go by the lease...

And have the CASH ready( NO CHECKS!!!) to give the manager, and get a reciept for full payment of rent for septemeber......pay the rent today....

Then by accepting septembers rent You have untill the end of september to move....

You have to understand the strategy, by paying in check they can return it on tuesday saying you violated the lease.

With CASH in your hands, probably the manager or the ditzy broad office worker will get all flustered and will accept it and write you a reciept for the full month of september...

I have paid my September rent. I spoke with the office since the last post. They are always professional and we both have exchanged information during this transition period more than once.

My situation will probably be resolved in one of two ways. The holdover portion of the lease does not apply because it is an early termination. Holdover only applies at the end of a lease term as dated on the lease.

1. Tuesday I have to discuss with the manager about whether I need to give another 60 day notice or,

2. She most likely will extend the 60 day notice another 30 days with the agreement I will turn over the apartment to them if I leave before the end of the month with out any prorated refund of rent.

I am praying for option #2 and will get it in writing.

Regardless the professional office staff explained that I have a lease and unless I violate the the terms I can stay the legnth regardless of my 'up-in-the-air' move date. There are no plans for eviction because they will not attempt to lease an apartment until it is empty or they have a final move out date and the termination fee is paid.

I guess i am so used to unprofessional landlords , ditzy worthless office broads, that to actualy have someone professional, and reasonable is a rarity.

I am surprised they want a termination fee since you are movng into another building they own...

The manage it, but there are seperate ownerships. The will not be requiring application fees at the new place saving $100.00. Plus they are extending their special lease rate for my benefit.

It appears that your lessor is dealing with you friendly. Keep this channel open with them. Explain the situation to them and you may inject something like it is a mutual benifit to rent the apartment for the next few weeks than staying in a motel.
