I had a one year lease that was up in October, but I did not yet resign. I did not even realize that I hadn't resigned it until recently when the landlord informed my boyfriend. She did not come to me about this matter except telling him that once. Now we are leaving the end of March and she says she wants $140 ($20 per month since lease was up which doesn't add up right to begin with). Can she do this? Isn't it her responsibility to get this paperwork completed, this is really not something that is on my mind 24/7. Also, I have been in her office to pay rent the past three months, why didn't she have me sign then?

As Long as you have given your 30 day notice to move TODAY, then you have fulfilled your obligation to the Landlord.

If the lease is NOT signed by both of you, then you still are a month to month tenant.

NOW it is ILLEGAL for her to charge any more then what was in the last lease since she had not informed you of any rent increase....Where is the certified letter she sent you?

Also since she is going to be a redneck scummbag landlord...you must cover your asssss

SO you must do a move out sheet and agree on the amount of damges to be taken out of your security deposit BEFORE you hand her your keys...or else she will keep the whole thing...eh she a redneck!

So while she is there Take lots of pictures of any damage and even a video...just so you have proof in case she tries to stiff you for anything...

If she does you will have to sue her in small claims court.

I'm sorry, but I forgot to tell you this part. My fault, I was thinking about it until you sent your reply. I am not trying to screw anyone just so you know, I am just curious. I have no problem paying what i rightfully owe. She taped a letter to my door about 30 days prior to my lease expiring that said when my lease renews, the rent will go up $25. Since this is still inexpensive in comparison to the city I live in (Mt. Pleasant, SC) I wasn't opposed to the increase (although I must say that these apartment complexes sure do have it made; not having to do diddly as far as repairs or cleanup). The landlord mentioned something about the fact that I WAS paying the increase, but I don't know what she meant by this. What was I going to do not pay the increase? I was planning or renewing my lease, like I said she never brought the paperwork over (she lives two doors down from me) and when I saw her or went to pay rent, she never said anything so I forgot (which I know is my fault). I just feel that she should have said, either sign this lease now or pay the month to month amount which is, I don't know, another $20 or $30. How can she, now that I said we were moving, say okay since you weren't paying a month to month amount before you have to pay the difference now that you are going to move out on me. It doesn't seem right. Unless, she screwed up and doesn't want to get in trouble by the property owners?

TRUE.....she forgot.. legally, she cannot charge you the BACK rent, you have reciepts and NO signed lease with the higher rent... so she will stiff you by not giving you back your security depoit...trust me i lived in Mt Pleasant, worked for WCIV and WCBD tv

Lived in the old section 119 pitt st. in an old 2 story house, it was destroyed by Hugo i left in '87.

You will have to sue her and the complex in court, since they have to return your deposit i think within 14 days.. and with a moveout sheet you will have a reciept to show a judge.

Thanks for the advice. Since I am not moving until 3/30, I'm going to talk to her before hand.
