What is the name of your state? CA
My kids and I live in CA and their father moved out of the state three years ago due to a career in the military. He took me to court before he left the state to get the child support lowered and at that time he was paying about $300 per month less than the dissomaster indicated....My children are in year round school so they are out every three months for about 5 weeks. When they visit their dad he tells them they can choose to liv ewith him when they are 12yr old. He is in the military and flies for a living. Most visits he flies his mother out to take care of kids and DOES not take vacation for their visits. He spends about 1/2 of the visit with them. He now lives in PA 45 miles from my parents so the kids are with them most of the visit (which my parents love) but my ex tries to act like everything is peachy and he could have custody of the kids easy...well he flew out of the state three times during the last visit and that is about the norm.
I don't want to hurt my childrens feelings they love their Daddy but he is filling their heads with this crap that they will be able to move in with him and his new girlfriend (who for some reason does not have custody of her daughter). I think it is a scare tactice but since I remarried three yrs ago my ex has been on a campaign to ruin what family life we have telling the kids we aren't a real family...it is very destructive.
Does anyone bottom line know if the kids CAN choose at 12 yr and is it PA or CA that hold the cards...I think it is CA since that is where all our papers have been filed previously.
