tn. My boyfriend and I wanted to get married, but we did
not feel sure about wanting to be financially bound by law.
So instead he paid for me to take his name legally (my papers even state this as the reason for my name change), and we said our vows privately. 1 1/2 years later, he starts an affair, and 6 weeks later, legally marries her. It sounds crazy, but someone said there may be a loophole somewhere that would state that we are legally married, thereby making him a bigamist, and making this new marriage invalid. help?!?

My response:

"Private Vows" are not legal or recognized in TN. TN is NOT a Common Law marriage State. In order to be married, you would have needed to apply for a marriage license and have your vows solemnized by some legally recognized method. Therefore, and despite your name change, and in the eyes of the law, you and he were merely "shacking up" - - boyfriend and girlfriend; nothing more.

He is not a bigamist. He has not violated any laws of the State of TN. It's time to move on.

His "legal wife" is already legally married to someone else, now is theirs still a legally binding marriage?

It matters to me because he is trying to find a way out of this marriage now, and I am trying to help him find all of his legal options, so "time to move on" is not at all what I needed, wanted, or cared to hear from IAAL or whatever your name is. Is this some kind of a comic relief Jerry Springer type site, or is someone interested in actually helping me find legal advice instead of Madame Renee prognostications? Now, the two of us are already living together again, and the "legal wife" is long gone. Besides, is this "Judge Judy?" What do you care what my reasons for asking are anyway? I am not on trial here. Just give someone a straight forward answer already, huh?
