What is the name of your state (only U.S. law)? Florida. There is a woman who is pregnant, she says by my husband. She is saying that she wants for him to sign away his legal rights to the child. Our attorney told us that unless she asks for child support and a DNA test is done, then he has no legal rights to sign away or keep. Is there some kind of form that can be filled out while a woman is still pregnant with a child by the presumed father which would stand up in court as a legal means of signing away paternal rights?

Also, I don't believe she is pregnant. Are there any laws on the books which would make a woman who fakes a pregnancy be responsible for any attorney fees that we may accumulate if we seek an attorney now and the entire situation becomes false?

There are no "unborn rights"

There is NO child - there is a fetus.

There is no solution or resolution to the problem until the child is born.

You should have no legal fees until that point.
