My fiance is legally separated in CA with 3 kids. His ex wife, has filed for divorce, but has not finished the paperwork. Is there anything that we can do to help complete this so that we can get married? We have two kids together and we would like to be able to move on. Please help.

My response:

There's nothing you can do with HER paperwork, and HER timetable. However, there is something your fiance could do on his own behalf, and without his wife.

Since there's a case file, all he has to do is file the Petition for Dissolution on his own, under the same case number, and pay the filing fee. That will get the "ball" rolling.

Get a book from your local Barnes and Noble on the subject, and get to going.
