Ripped off by private individual, can I make a case?(read please)

What is the name of your state? NY

Ok well I purchased an 88' Mustang from a private owner (for $1000). Now basically this. I bought the car and the next morning the engine died. They had claimed that the car had 98k miles on it. But the car does have a 5 digit odometer. Now with 98k miles on it and it being 17 years old that would mean the car would have about 5000 miles per year which seams like a small amount. And the driver of it supposedly drove it way out to Long Island everyday for his job. In anycase I found service receipts that they gave me that read 143k miles back in 2002. Along with receipts showing that the car had an alternator fire. Now we had asked about things such as accidents which they never mentioned to us. So now my mechanic says that the engine is blown and its done. I would like to find out if the odometer has been tampered with. Now the title and carfax read that the car had 98k miles on it. But if the car indeed does have 198k on it does that mean that they have falsified documents? And isn't tampering with the odometer on a car a federal offense? Could I demand my money back or even make a small case over it? Cause it is going to cost me more to put a new engine in then the car cost me. And on the bill of sale they did not put in "As is", so if the car was broken and had I problem I was not aware of it as you can see. Any info is greatly appreciated! Thanks!

Two places to start your research.....

The MOST you can get in a small claims case would be $1000. So, if you want to try it, go ahead.

Where can I get an Affidavit Claim Form?
If you mean how do you file a small claims lawsuit, go to the small claims court in your county.

No I was reading the terms and agreements for the carfax guarantee. And it says you need an Affidavit Claim Form notarized to put in a claim with them.
