Lemon lawsuit filed - will no further problems hurt my case?

About two weeks ago, I had a law firm file a lemon claim on my 2002 Mazda. It has been in for repairs 9 times (seven of which were for a check engine light, which was eventually found to be caused by a factory defect). Overall, my car has been out of service for a cummulative 38 days in the first 9 months. I have been informed that Mazda does not have an arbitration program, and, thus the court is the only solution. The trial is set for September (eight months away!)

Will it hurt my case if my car no longer has any related problems during the time I await the court hearing?

**A: no because the car may have already being deemed a lemon under the lemon law. Anyway, did you know that Mazda is Japanese for lemon?
