I filed a small claims suit against my ex for the money he owes me. He has responded to my claim but he is claiming that I gave him the money as a gift, and then wants to counter claim 1500 for a laptop and fax machine that I don't have. (I kicked him out of my house and put all of his crap in my garage) The thing that bothers me is that he will lie like that, even under oath. - lack of integrity. Ok, anyhow I have a copy of the check from the bank, and in the memo area I wrote "Car down pymnt for C$" (his nickname) and I have e-mail correspondence between he and I that states the following:

Does that mean you don't want the laptop?


Question: How can I proove that it was a loan?
Question: Does he even have a case against me for the counter claim? He picked up all of his stuff from my house a long time ago. And now he wants to claim a laptop and fax machine?
Question: Can I question his credibility and how? (Ex: He has bad credit, a previous criminal record, and smokes drugs) I don't - I have never - that's part of the reason why I kicked him out! He's a bumm and likes to leach off of people! He is upset about the breakup and doesn't want to pay back the money. How can I proove this?

Please Help- Isn't there any justice?

dont feel bad i have almost the same problem but my problem is a 2000.00 problem for a t.v. that he asked if i could put it on my credit card and that he will make the payments for me. he has decided that he is not gonna pay so now im stuck with the bill and he has the t.v. he also told me that he is going to say it was a gift. what ever happens like everyone keeps on telling me learn from your mistakes thats all there is left to do. i personaly wish i could ring his neck... all i gotta say is fight it thats what i am going to do. give him back a little of the pain that he has caused u..

I won judgement!

Thanks Mariar21 for the positive response! I went to court yesterday, and won Judgement! All I have to do now is collect the money. Key thing in my case, he had nothing to proove his case. I had e-mail correspondence between he and I. Good Luck!!!
