In the State of Georgia. An acquaintance wanted to buy a house. Myself, my husband and a friend agreed to help her renovate the property. She obtained a loan from a Judge for the construction on the property and after we renovated the property she obtained another mortgage to purchase the property. We all had separate agreements with her as to how she would reciprocate. My husband did exterior repairs, priming and painting on her house, garage and shop with the understanding she would help paint my house. She agreed to pay me in cash and kind and reciprocate by working on the inside of my house. She agreed to pay our friend $2,500 and give him an old truck she no longer drove (He got the truck but no money). She had ninety days to renovate her house under her agreements with the Judge and the mortgage holder. We completed the work in 64 days. I then set 90 days for the completion of my house. I managed to get her to come over and hang 2 1/2 rolls of wallpaper which I had cut to size. That day she told me and a witness that was the last time she was planning on doing any work on anyone else's house. My husband and I ended up separating because she stirred the pot and told him and a witness there wasn't any sense in doing anything to my house because I was planning on returning to Indiana. Just prior to the end of the 90 days I sent her a letter telling he if she did not reciprocate as agreed, I would have to charge $2,700 for the work I had done on her house, gas and wear and tear on my truck for moving her and hauling trash from her property, and the construction materials I had taken from my house and used on hers, otherwise I would take her to court. She did not contact me. I filed in Magistrate Court. The hearing was set for Dec.07, 2001. I asked for $2,700 plus costs for hanging and finishing 31 sheets of sheetrock, laying and grouting 270 sq feet of ceramic tile, reimbursement for gas and a repair to my truck, and the costs of the materials I took from my house to use on her house. The person hearing the case was not our regular Magistrate Judge. In her closing statement the woman claimed she had paid me in kind with 10 sets of drapes, 22 sets of mini blinds, had given me the cabinets for my kitchen and had bought my vehicle tags in exchange for the work I had done on her house. That was all false. The material items she claimed she gave me were among the 20 or so loads of trash I hauled to the landfill for her and she knew it. I purchased my own vehicle tags. I objected but the hearing officer disallowed my objection on the grounds I had my opportunity to present my case. The person hearing the case said she would take the matter under advisement and would made a decision in 5-7 days. Over 30 days have passed and I have not heard anything from the court. I know there was bias because of the involvement of a Judge as a lender, and the defendant and person hearing the case were overheard greeting one another by first names and discussing the case just prior to court. Additionally, the hearing officer refused to accept the receipts I presented for original purchase and replacement of the construction materials and vehicle repairs. I feel the Court has had ample time to make a decision on this matter and I want to know what steps I should take at this point. Her house was finished in June 2001, yet the only work done on my house has been what I have done. My husband and the defendant are now dating, I suffered a heart attack doing the work by myself and I fell nine feet from a ladder breaking my jaw because I had no help. What can I do at this point to receive fair and unbiased justice?
UPDATE: Afew days after posting I received a decision from the Court. I was granted judgment for $39. I didn't receive anything for 60 days of work. I intend to appeal.
