MN...Background in a nutshell...My husband has gone to court 3 different times since '92. Each time awarded custody of his two children. Ex paid him CS 2 yrs ago for about 1 year. Oldest child left us at age of 16...is now 18. Ex is manipulating the 13 yr old to come and live with her as there is currently an order pending for her to pay CS again for the 13 yr old. We are tired of going to court, tired of spending thousands of $$, tired of seeing my step-daughter being brainwashed.

My question is: Could we have our attorney to put together a letter stating that my husband will not persue any CS from her for the next 5 yr as long as she does not persue taking my husband back to court for custody of the 13 yr old? Would something like that stand up in court? It is more important for my step-daughter to not be caught up in this garbage and have consistancy in her life than getting a monthly check.......however, if the ex wants to continue to play this game, what are our alternatives?

If you write up an agreement stating you do not want child support for said child and you both agree, sign it and bring it before a judge to sign. I would seek out a paralegal to do the paperwork (much cheaper) and have ex wife sign and ex husband sign and that should end the games. Now, she may not agree, because maybe she wants or needs money now. But goodluck and I hope I answered your question.
