I live in California, and my problem is: My ex ran up a credit card in my name, and it was turned over to a lawyer for collections. It's about $4,200. They already levied my savings account, and are threatening to do it again, if I don't make $600.00 dollar payments a month. I can't afford to pay that much, and asked them to make it alot less a month ($100.00), but they say that is the minimum payment I must make. My question is, as long as I am making an effort to pay something every month until it's paid, can they legally make me pay that enormous amount a month?? What are my rights as far as my payment amount goes??

They do not have to take less and they CAN garnish your wages to get it. Its likely that the $600 a month is what they'd get if they went after your paycheck,hence their demand.

They obviously have a judgment against you - when did that happen ??
