Mississippi. A tree on the edge of my front yard fell taking down several telephone poles across the street. The tree was leaning, but had no apparent sign of rot or other damage. The tree was on City right-of-way and the City took responsibility for removing the tree. A car stopped at a stop sign near one of the poles was totaled. Fortuneately, no one was injured. The owner of the car (who was only carrying liability insurance) is asking my insurance company to pay the replacement cost for the car. The insurance company is saying I have no liability. Is the insurance company correct or are they just stalling?
