Hi, We are in the process of building a pool in our backyard. We have one neighbor sharing our backyard fence that has 11 children living in one house which are left alone unsupervised, the oldest being 12 yrs old. We caught one of these kids (looked about 6 yrs old) in our backyard yesterday after climbing the fence.
The kid could not get back over the fence and was "caught". We drove the kid back to his house and called the Sherrif to come out to make a report.
Our pool is still being constructed. What is the kids who tresspass in our yard gets hurt? What if they go in the pool and drown? Is it mandatory to fence the pool off from the inside as well as keeping the yard fenced? We have big dogs, what if they get attacked by the dogs in our backyard? I would like to know what the liabilities are concerning people who are not authorized to be on our property? Thanks for your consideration, I know we are in a sue happy state!!

Make sure you have at the miniman $300K liability on your homeowners.....and maybe even consider getting your self an umbrella policy that covers atleast one million in liablity.

You must mitigate the "attractive Nuiance" a swimming pool causes by either erecting a privacy fence that a child cannot climb over, covering the pool or some other means which I'm sure your homeowner's insurance adjuster can inform you about.

Your jurisdiction has strict building codes governing pool fences and gates.
Contact your local building department for information.

tammy8 hit the mark. Up your limits on the homeowners and do get an umbrella policy. Post no tresspassing signs. How about razor wire on top of your fence? Seriously, fences and covers are great, but kids will be kids, and the potential for a lawsuit is substantial, and your only saving grace would be your insurance policy.
