:confused: My nephew took a car out of my yard and drove it to school one day without my knowledge/permission. (The car was uninsured and was sitting for repairs) . One his way home-he rear ended another vehicle causing some damage. The other guy got an estimate for repair but So far-he (my nephew) and his mother have not made an attempt to pay. He has called me and threatened to take me to court because I am the registered owner of the car. I would like to know if I am going to be held liable or if his parents will be. I live in Florida.

My response:

All of you are likely to be sued - -

The nephew because he was the negligent driver;

The parents because driving a vehicle without permission is a "purposeful" act;

You, because you're the owner and the keys were available - - despite the fact that you didn't give "actual" permission.

No-I did not file charges for auto theft. It is my nephew and I couldn't/wouldn't do that to him.
And I do not understand how I could be liable simply because he was able to find the key to my car....
