Hi.
May I just ask what is my liability as the receiver of a package that is not mine. The package was tracked with signature confirmation. It was addressed to me. I purchased something online once and the seller mistakenly shipped an item to me the second time around. She is threatening legal actions from police, court and some customs related problems for me. I plan on returning the package but I just want to let this sender know that threatening me is not a good action on her part since her package is still with me.
This is a part of the message:
"I will take legal action to include contacting the authorities in Santa Rosa, customs officials & will file a small claims case in Wisconsin. The person who signed for the jewelry would have to appear in a Wisconsin court. The judgment WOULD BE in my favor. "

Please note that the package is in my name...
Thank you for any suggestions you may have
What is the name of your state (only U.S. law)?

If you accidentally receive someone else's package and the sender will pay for the shipping back, then you need to do that as soon as possible.

If you refused to return the package, then the other party can successfully sue you, but the suit would need to be filed in your state. You would not be liable for return shipping costs. The threats about contacting the authorities is a joke since it's purely a civil matter.
