Liability Question



There was an accidental fire at a vacation home that I own, while my guest were staying there, some family members, a sister and her family. The fire damaged a neighbors house. My homeowners insurance had liability, and my sisters family had no insurance. Neibhors insurance company paid to repair the damage to their own property, however my insurance refused to pay anything on the basis that I wasn't there when the fire took place. Now my sister is getting letters from the neighbors insurance co asking for repayment of the claim they paid to fix the neighbors house. Question: If I own a vacation home, and I'm not there, then I'm not liable for anything accidental that happens there, is that how it works?What is the name of your state?

Well, you're posting as 2 different people, which simply looks suspicious. Also, none of the answers will change.

The insurance company of the homeowner (who wasn't there) is denying responsibility. Read the policy to see if there is a loop hole. The person who caused the damage is responsible. The insurance company is only required to defend their client, and their client isn't being sued.
