Liability question

A friend of mine recently learned that her partner has had, and known he has, the Herpes virus for a long period of time and did not inform her. She has now gone form medical advice.
Is her partner liable if she has the disease. Before dating she asked him if he had any diseases and he indicated no he did not. This was supposedly a friend and they have known each other for 14 years.
