Libel and harassment

What is the name of your state? New Mexico

An individual is oppossed to a website I am afiliated with, and has chosen to make a webpage "exposing" me. He has included my full name, maiden name, spouse and child's name, home phone number, previous addresses (he has one listed as my current address), previous business ventures, bankruptcy information, employers, etc. My phone is not in my name, so how he got it, I don't know (he claims he "found" it online, but I have NEVER posted my home phone number anywhere on the Internet).

Below is some of the information on this website, with personal details edited out.

*edit* is an independant saleswoman for *employer*. What does she think of her supervisors? In her own words, "We had a guest director who was so f---ing preachy! It was unbelievably annoying." Maybe she should be "exposed" to *employer*, as they likely don't take kindly to backbiting. In that vein, *employer* International was contacted on February 22, 2006, and given copies of *edit* comments about the company she represents, and they were informed she participates in *website* activities while representing *employer* (by using the company name in her screen name).

She is a controlling housewife. On a forum she posted to, she said of her husband, "I banned him from using the ATM w/out my consent.." She graduated from *city* High School, with the Class of 2000, and is fond of Saturn cars.

At one point she sought to sell a stereo on Saturn message board. She and her husband filed for Chapter 7 bankruptcy in 2004. Even as recently as February 2, 2006, she lamented her financial situation, saying she had to stretch *edit* paycheck, just to eat.

They couldn't even pay their Dish bill, and they can't eat, but while *edit* ordering her husband around on ATM usage, she's buying Nine Inch Nails tickets, so don't feel too sorry for this family of white trash.

Guess the "home business" isn't doing too well, if they can't eat, but then again *edit* used to failure: She owned a failed *edit* business at one point, as well. Perhaps this would be why she lashes out at guys in chat rooms.


Many of this is simply not true. This individual has also threatened physical violence against myself and my family via Instant Messenger (this is documented via screenshots of the conversation). I have sent this individual an email (CC to myself) stating that he had until 7:40 a.m., Thursday, Feb. 23, 2006, to remove my information from his website or I would seek legal action. He responded, saying the information posted was "public" and would not be removed (how a home phone number not even in my name is public, I don't know.) He has been informed that any further contact with me from him will be considered harassment.

The addresses he has listed are occupied, so it is now possible that he is putting innocent people in harm's way.

I can give the link to this website, if requested. I don't know if that is allowed on here or not.

I do plan on pursuing the harassment by filing a police report, but is there anything else that can be done? I'm not sure if this is considered libel/slander and if it is "free speech" to post an individual's information online for all to see.
