After he left, I called two XYZ Equity reps to give them small bits of how outraged and embarrassed I was for my company since we were associated with this man. I also called the borrower to apologize again for the behavior of the attorney. Then, Ms. B made the comment that he could have at least taken a shower before he left this morning, as he smelled a bit offensive. I was not as close to him as she was and did not notice. Luckily, Ms. B seems to only blame the attorney rather than our company for what happened. However, I am a bit concerned since XYZ does not allow the borrower to choose the attorney in an attorney and insurance preference state. The reason this concerns me is because the borrower’s mother is a realtor who is very aware that Ms. B should have had the option to choose an attorney. I also received a call from her upset mother telling me how Ms. B was now in trouble at work since she arrived so late. I informed the mother that I had already called XYZ and that they assured me he would never be used again. Also, that I am planning on having the title company call later to ask to have the package faxed back to them if it has not been done by the time I call (since I have no faith that the attorney will remember to do so himself) and to get a copy of his license. I would like to be able to reaffirm to the mother as well as Ms. B that the attorney was licensed.
This is the second time that I have had to deal with this attorney. The first time was on a Friday, I believe at 4:00. He did not make it to that closing until about 5:30. He also did not explain any of the paperwork to that borrower either. He simply put the papers in front of them and asked them to initial or showed them where to sign. I had to apologize for his behavior that time as well and made sure the customers could reach me over the weekend if there were any questions on the paperwork. I was very glad I had gone to the first closing as well since he did not have a witness other than myself. I had mentioned to XYZ representative previously that I did not care for this attorney and told him I would get an email together with his name and such sometime soon. The experience today, prompted me to get this taken care of now. I have never been so embarrassed because of an attorney. I also did not appreciate feeling like I had to do part of his job so that it would get done since he did not seem fully capable of performing his duties. I have told two XYZ representatives that I will never send XYZ Equity another loan if I have to deal with this man again. If I have had one bad closing and one horrible closing with this man, I have great pity for anyone that has had a closing with him and their lender did not attend. I cannot even imagine how closings without another knowledgeable person could have gone. I would like for XYZ/LMN to ask for the $350 attorney fee to be refunded. I am fully aware that this does not affect my borrower, or me but feel based on my horrible experience and on principle; this attorney's company should not receive that money. One man has managed to embarrass and shame my company as well as XYZ Equity and I do not feel that the company who employs him should receive payment because of this.
XYZ Equity and LMN Title have been absolutely wonderful to deal with. I have been able to reach people promptly and get answers that I have needed. Also, when there has been a problem, such as this morning, everyone gathered around to make the experience a bit less atrocious for the borrower and try to speed the process. I do not want a man like this to pull down the names of XYZ Equity, LMN Title company or my company, ABC Mortgage
