My wife is employed by the state of Georgia and works in a county office supervising several people. Her boss is a habitual liar, not knowledgeable in department procedures for the work being done, and is generally at odds with all under her in the office. She has written a warning letter to my wife for insubordination listing three instances that are totally false and done in front of witnesses as proof they are false. Her boss has also communicated verbally with other employees about having my wife's employment terminated. This has just happened and my wife has not yet discussed the letter with the department director (who is new, by the way and not totally aware of the on going problems). Best case, this will be resolved by the new director when my wife makes a written response of the details and provides the witnesses names. Worst case, if another reprimand is written by my wife's boss, she could be fired.
Our question is, if fired, could my wife file suit against her boss and/or the state for libel and slander? She does have an advantage in that she is not the only employee in the office that has been "attacked" by her supervisor. Could she legally use a hidden recorder in the State of Georgia to document threats and falsehoods stated by her boss? Thanks all for your help, this has been extremely stressful for my wife who is a few years away from retirement and the loss of health insurance and income would be disastrous for us.What is the name of your state?
