My name is Nanette, I'm the editor for a new author named Amy Blankenship. We are currently working on the 3rd book in a series of 10.

The problem is someone posting at Live Journals that the storyline is plagiarized. This is not true whatsoever. Amy formerly wrote fanfictions & the girl thinks that the story is about the characters by another author. The characters & storyline are original.

The girl/woman has posted Amy's personal information, email, websites, etc. to this journal for everyone to harrass her. They have gone to places like Amazon & Authouse that sell the books & left reviews stating copyright infringement, etc. They have even joined a private group under false names to harrass her.

We have contacted Live Journals asking them to remove the post. They will not. The publishing company has received emails from irrate people also & have told us they would be ignored.

I believe we have a case against this woman who made the original post, what do you think?

From what I've read, no one believes these 'ner-do-wells. So, what damages have been suffered?

We are concerned that this might ruin her reputation as an author & as I said, she is contracted to write a total of 10 in the series. If no one purchases the books in the series then she is also out future income.

We do not yet know what effect these remarks have caused however, when they started leaving bad reviews at book seller websites... Well, we are very concerned about this.

My response:

Courts do not deal in "speculation". When you can point to provable, actual, damages then we'll have something to talk about; e.g., If you can prove a nexus between low book sales and the remarks made, then you may have provable damages.
