Hello:

I have unable to determine if a license to operate as a judgement enforcement business in New Jersey is required.

I have tried to ask various people without anyone knowing or be referred to useless informational sites.

I know that I must register the business as a DBA with my county court house, but I do not know if I am considered a "collection agency" and required to obtain a license,be bonded and follow special rules.

Can someoone please finally help me with this before I proceed with starting this business.

If licensing is needed please provide the agency that i must contact.

The bonding requirement applicable to collection agencies is written broadly enough to inlude what you are going to do; therefore, you are required to get a bond from the Commercial Recording Program of the Secretary of State. The applicable law follows:

Under New Jersey Permanent Statutes 45:18:1, No person shall conduct a collection agency, collection bureau or collection office in this state, or engage therein in the business of collecting or receiving payment for others of any account, bill or other indebtedness, or engage therein in the business of soliciting the right to collect or receive payment for another of any account, bill or other indebtedness, or advertise for or solicit in print the right to collect or receive payment for another of any account, bill or other indebtedness, unless such person, or the person for whom he may be acting as agent has on file with the secretary of state sufficient bond as hereinafter specified.

Under New Jersey Permanent Statutes 52:16-8.1
a. Notwithstanding the statutory provisions to the contrary, for any of the areas listed in subsection b. of this section, whenever a law of this State directs a filing to be made with, or a certification to be obtained from, the Office of the Secretary of State, that law shall be construed to mean a filing with, or a certification from, the State's commercial recording program, no matter where the program is assigned as part of any government reorganization plan.
