What is the name of your state? Arizona I filed Chapter 13 BK in 2003, and became unable to keep up payments so converted to Chapter 7 in November 2006. I had a lien on my home by the homeowners association, for a judgement they obtained properly a long time ago for $965.00. This was listed in the Chapter 13, and followed over to the 7. However, I had paid down from $4500.00 to $3900.00 a debt I owed them during my Chapter 13. They have no judgement or lien for this amount, and it converted over into the Chapter 7 also. The Chapter 7 discharged on March 6, 2006, and I am refinancing my mortgage. There is only the lien for the $965.00 appearing on my title, plus one other from a credit card company, for $1200.00. The management company for the homeowners association says they can attach the larger amount owed right onto the lien for $965.00, so I must pay all of this in order for them to allow the refinance. I had an attorney for the filing of the Chapter 13, however, after very little time after the filing, he informed me as far as he was concerned, I had exhausted the fee of $2500.00 I had paid him. (He was already paid in full). So, I had to proceed on my own, and prepared and filed the Motion to Convert, and additional creditors, verifiying any incorrect addresses, etc., with the BK court. At this point, with the title search being completed, and my mortgage broker wanting me to decide how to proceed, I really don't know what to do. The management company is being fired by our homeowners association, due to complaints by myself and numerous other homeowners for mismanagement. Both the first lien, and the larger amount they claim I owe them include these mismanagement issues, of which I have proof. I attempted six times to get these issues to the homeowners board, through the management company, as we are directed to do, and I found none of this information or my requests were ever heard by the board. Can I approach the Board now, and ask for them to put a stop to the management company pursuing this any further until this is reviewed, to cap costs on attorney's fees on their part against me? Does this amount get discharged in the BK? Can I file a Motion to Vacate the lien of $965.00, and include this larger amount? I really need some direction. I called my original BK attorney, and he will not talk with me. I have filed a complaint against him for this, and discovered I was not the only one. But that does not help me now. I am totally on my own. I am disabled, with very limited income, and most of this debt originated when I was married. Any help or direction would be so very much appreciated.
