What is the name of your state? va
my ex wife recently past away -we had a divorced in 2002
she stayed here with me and i took care of her
she had a old life insur. policy with aetna -thru her employer
which was federal government --she didnt change anything on the policy
which i was benficary when we were married.
we knew about the ex husband law and contacted the resource center about it.
they told her it didnt matter because she work with federal govt.
well aetna is not going to pay to me because of the state law
it is a non erisa policy
the family resource counsel has ask for the policy from when it was issue
back in 1972.
they want to see if the naf policy is govern by federal regulations.
or open to state law.
do you know what else i can do?

Does the company want to pay anyone else as beneficiary (her estate, perhaps) or no one at all?

If you don't want to get your own attorney on this, file a complaint with your Virginia State Insurance Commissioner (has a website and you can also probably find the phone number address in your phone book), but don't do this until the Family Resource Counsel has looked into this for you and gotten a copy of the policy.

yes they will pay the estate the has to be paid .
the problem is that my ex wife wanted me to have this money 20,000
the resource center process two insur. assignments
for the funeral,and burial.
which left me 14,000
the head of the family resource center dept of navy at quantico va.
knew my wife and and knew what she wanted.
yes i have thought about getting a lawyer but it would eat alot of the money
though.
im not sure since she worked for the government that the state law doesnt apply
which is what the resource people were thinking.
its sad because her relatives werent willing to help her and now theres a chance the money will be split up.
do you know of any laws that might be there in such a case as this.
