What is the name of your state? Florida

My uncle died a week ago. My uncle was a resident of florida but his wife lives in the Caribben. She is listed as his beneficiary. She contacted the insurance company and was told that no money can be paid to her since she is not a US resident. She is here legally as a visitor. Is this true

The insurance company may be giving her a snow job and it does not seem as if they are telling the truth. Under normal circumstances, residency should not affect beneficiary status.

Beneficiary designation is ironclad and her status as a surviving spouse gives her power in this situation. Tell wifey that she should be getting her own attorney to deal with the insurance company or if she can't afford an attorney she needs to file an official complaint with the Florida Department of Financial Services, 200 E. Gaines St., Tallahassee, FL 32399-0300, phone number 1-800-342-2762 (website www.fldfs.com) so that they can investigate this matter and try to assert her rights if the insurance company is wrong.
