Most of the Life Insurance Company's underwriting requirements state that in order to buy life insurance the applicant must be a US citizen or a legal resident with a green card.
What happens if a person, who is not a US citizen or a legal resident with a green card, applies for life insurance stating in the application that he/she is a US citizen or legal resident but that is not true because his/her status is of a "illegal resident", and instead of giving a SS# gives an ITIN number, also called W7 which is given by the IRS to illegal residents in order to pay taxes?
Is this consider a material misrepresentation?
Can the insurer deny a claim based on these facts?
What is the responsability of the Agent that wrote those applications knowing that it contained those misrepresentations?
Are there any insurance companies in the US that sell life insurance to people that are consider "illegal residents"?
