What is the name of your state?
Wisconsin
My uncle's death was never reported to the social security death index.
I contacted the social security office they stated i can still claim his death
by bringing in the needed information. My aunt states there is a life insurance
policy or policies that she never collected on ( she threw away the policies)
Would it help that i would report his death now from 1976? Or is it best to
have a lawyer handle such case? Could a insurance company still after
such lenghtly time turn life insurance policies over to the state?

File the claim and see what happens. Then ask again if there is a problem. Lots depends on the type of policy and whether the company has the records and whether it will seek to or be able to claim the benefit of the statute of limitations.
