What is the name of your state (only U.S. law)? Colorado

A family member pleag guilty to an F4 Theft charge for stealing 120K from her employer and was given probation. While on probation she stole another 60k from her new employer. She was charged with 2 F3 theft and 1 F3 computer crimes counts. We have been told a plea bargin is in the works but are uncertain what kind of deal they will offer her. Should we expect prision time or is she likely to get some sort of home detention?

Judges tend to frown upon a violation for the same crime. What will matter greatly is whether or not a suspended sentence was also imposed.

Prison time isn't guaranteed but with charges like this it is likely. She may also have to answer for the original charges again although they are a little less serious then the new charges that she is facing now.

If she is sentenced to do time there may be a mandatory minimum imposed. The minimum for a Class 4 Felony is 2 years and a Class 3 carries a minimum of 4 years. She should prepare for the very real possibility of spending a very long time behind bars.
