here is my prob. i didn't get my rent check (again) this month. i called to talk to them about it. they said that she is going to file (or has.. can't remember) bankrupcy. said that i was a creditor and that she didn't have to pay me. that they will be out of the house when they find a new place to live. they changed the locks and have damaged the house (need to replace all the carpet in the house etc)
so now we are doing the eviction. can i sue them? is there any way to get my money for the damages? what ways can i go around the bankruptcy? this is crazy!! there is nothing i can do about this and i thought laws were meant to protect. who? lazy people who ruin a house in 3 months and decide to play rather than pay rent? they broke the lease in 7 diff. ways and i can't do anything but sit and wait until it goes through the courts. by then they will be in there next house doing the same thing. how can they get away with this?
please!!!!!!! help me!!!!!!!!!!!!

Sorry man.that is what lawyers are for, go see one today...

Remember: Lawyers are a TAX DEDUCTABLE expense against your rental income.

You started the eviction, which was the right thing to do.

Now, after the bankruptcy is filed, all procedings against the tenant will be stayed, but you can petition the bankruptcy court to let the eviction go forward. You won't be able to get any money except as a part of the bankruptcy decision, but the court will agree that the eviction should go forward as a proceding which is not about money.

You will probably need an attorney who does these procedures.
