I'd like to know if a will in Minnesota can be contested. ( A Trust ) in probate. I was told that MN law states that 50% of a parents income is automatically divided amounst the children of the first marriage. Rather is the will or not. Is this info correct. What if there were child abuse involved in our lives. Would this entitle us to his money. For all the damage he cause us lids.

I don't know what law you are referring to. Even the rules of intestate succession (for estates without wills) do not say that exactly. Although if both parents die it can work out that way. A will overrides all this anyway. Never heard of anything to do with child abuse making a difference. If you could bring a civil action against the deceased you might get something, but I suspect the time limits have far run.


Trusts aren't affected by either probate, wills, or intestate succession. Trusts transfer based on what the trust document says.
