LL/Tenant
I lived in a run down mobile home for 8 months in WV. My rent included all utilities, trash removal and heat. The entire time I resided there, I asked my LL's to make repairs.All spring, my furnace would 'pop and crack' and blow fuses. The ducts were so deteriorated, you could see the ground beneath. I needed heat so I purchased a kerosene heater and a small electric heater for the bedroom. I only deducted the expense of the fuel from my rent ( with their approval). In the summer, my trash sat so long in (my) garbage containers, I finally had to dispose of the containers and the trash myself. Winter came and I had no heat again. This and a multitude of other problems including weak floors, leaky ceilings and frozen/broken water pipes. Also, the many cut off notices as well as disconnections due to their failure to pay the utility payments. The final straw was when I asked them to(finally ) fix the furnace and I was told they were "Tapped out" and could I hold out until Spring. I said no and asked if I could terminate my lease. I gave them 30 days and explained why I was leaving. They were informed that if utilities were disconnected before my 30 days, I would take legal action. My water was disconnected. ( third offense )
Do I have any legal recourse? Now I have been forced to move, pay a security deposit on my new apartment,phone and electric. I have had to give up 2 cats (which were like children to me) and many household items ( washer, dryer, air conditioner, ect.. ) to move into a smaller home at a higher rent and more expenses. I could not afford to stay (there) with no heat and was rushed to find somewhere to live. Can I be reimbursed? Is this a Breach of Contract case as well and LL/Tenent? Any suggestions? Thanks!
