I lived in a run down mobile home for 8 months in WV. My rent included all utilities, trash removal and heat. The entire time I resided there, I asked my LL's to make repairs.All spring, my furnace would 'pop and crack' and blow fuses. The ducts were so deteriorated, you could see the ground beneath. I needed heat so I purchased a kerosene heater and a small electric heater for the bedroom. I only deducted the expense of the fuel from my rent ( with their approval). In the summer, my trash sat so long in (my) garbage containers, I finally had to dispose of the containers and the trash myself. Winter came and I had no heat again. This and a multitude of other problems including weak floors, leaky ceilings and frozen/broken water pipes. Also, the many cut off notices as well as disconnections due to their failure to pay the utility payments. The final straw was when I asked them to(finally ) fix the furnace and I was told they were "Tapped out" and could I hold out until Spring. I said no and asked if I could terminate my lease. I gave them 30 days and explained why I was leaving. They were informed that if utilities were disconnected before my 30 days, I would take legal action. My water was disconnected. ( third offense )
Do I have any legal recourse? Now I have been forced to move, pay a security deposit on my new apartment,phone and electric. I have had to give up 2 cats (which were like children to me) and many household items ( washer, dryer, air conditioner, ect.. ) to move into a smaller home at a higher rent and more expenses. I could not afford to stay (there) with no heat and was rushed to find somewhere to live. Can I be reimbursed? Is this a Breach of Contract case as well and LL/Tenent? Any suggestions? Thanks!

You NOW know what a trailer trash landlord is......

You really should be ashamed of yourself for putting up with those conditions.since it was Illegal, and he could have been fined by the town, and if you sued him in small claims court you might get some money back...

And is is ILLEGAL to cut off any services even if you dont pay the rent, the landlord could be liable for triple damages.... And you didnt have to give up your appliances you could have sold them...or stored them temporailly.but that was your dumb decesion....

If you can get your items get them today or the landlord will sell them and keep the money..illegal but he's a hillbilly

But i am really ticked off at you....how dare you put the landlord ahead of the lives of your cats ?????

PS.he has no money for the trailer because... he spent the money on drinking drugs or he has a mistress the wife doesnt know about.

DJDJ....You're so funny.. I thought this web site was a place to get some real advice, not a place for morons to hang out and put their two cents worth in. I had enough crap from my former landlords, I dont need your crap too. FYI I'm not stupid. These were former friends. They promised to do the work. My cats are with family members. I gave my appliances to my kids.

BUT you didnt lose your cats, and your appliances

But living in West Vriginnie you have a oversupply of illiterate people and your landlord was one of them.

Time to get a better JOB, stop smoking drinking doing drugs, and you will have enough money NEVER to live in a run down place again!

Is that better advice?

Well.. FYI again -
I have a College Degree. I work a decent job and pay my bills on time. I happen to rent because its my choice. There may be illiterate people here but none compare to you. Maybe you should take your own advise and quit smoking, drinking..ect.. Maybe then you will have more time to learn how to spell. Find another hobbie, honey. This one requires intelligence, something you are definately lacking.

jt your ll were very wrong for what they did to you. what they have done is breach of contract and very illegal. and i dont know who this dj dj is but he or she sounds like your former ll trying to insult you to the bitter end. he or she sounds more like al gore trying to show reason for screwing people not to mention trying to insult you. and like al gore he or she cant even spell. my advice to you dj dj is to go back to school and get an education before you try to insult dumb hillbillys from virginnie you ignorant ass. my advice to you jt is to get a good attorney and take them to court for breach of contract. good luck to you jt. dj dj get a life you al gore wanna be.

We should ask if jt has a college degree and is so smart and has a good job .. then why on earth would anyone live in a such run down trailer?

lanlord/tenant laws

JT, go to http://www.nolo.com/encyclopedia.com. You will be able to find the laws for your state. I have found it to be a great sight. Another sight is http://www.baltimore-welcome.com/handbook. Landlords often say it is hard to find good tenants. I have found it hard to find a good lanlord. As far as djdj goes, obviously this person has never lived in the "REAL" world and does not understand that mommy pays for everything we do. I hope these sights help you out some.
