at the begining of april i put a down payment on a car, i should be making payments for a few years. the first payment is due in about a week. i just recieved the title to my car in the mail, i know its a mistake becuase its not paid off. i asked the dealer , said this happened a few years ago...they told me i was lucky. that the bank is now out of the money and i own the car, they might try to get me to pay but the dealer got their money. i then told them that it was the car that i had recently got from them, they then looked through the paperwork and realized they did something wrong. they said i should wait to see if or what the bankk says to me, or i could fill out the rest of the paperwork and continue paying the car.
whats the deal with all this?

Sorry to give you bad news..... but you still have to pay.

Here is the deal.....
You signed a CONTRACT agreeing to repay the money that the lender loaned to you. The title to the vehicle is supposed to be security for the note. The fact that the title was sent to you by mistake has no bearing on your repayment agreement.

So, here is what will happen:
1) The bank will realize the error and will get the state to void 'your' title and to issue a corrected one, or
2) Your bank will not catch the error and you will continue making payments until the full agreed amount is repaid, in which case you will then ask them for a 'paid in full' reciept, or
3) You will stop making the agreed payments and the bank will sue you for the unpaid amount. They will then get a judgment against you and start to seize property (even the vehicle) towards enforcing the judgment.
