What is the name of your state (only U.S. law)? Alaska


My grandfather isn't expected to survive past Monday according to his doctor. I don't know what to do... I have an awful lot going on in my life already. My daughter was diagnosed with a rare liver cancer when she was six months old and we have been living hundreds of miles away from home since August in a hotel room (thank God my insurance pays for the room!)

My daughter will be ending treatment next month thank goodness... But now I have to worry about my grandfather and his estate since I am his Personal Representative... Aka executrix.

They're keeping him comfortable... That's all they can do... :(

My uncle ran away to Asia several years ago and has not had any contact with anyone in the family since he left. He is supposed to get half of my grandfather's estate... But I have no idea how in the world I am going to be able to find him to give him his share. My lawyer told me several months ago that I might have to actually go to Asia and try to find him in order to satisfy the court! HOW am I going to do that with a sick baby? WHERE would I even begin to look?

Sigh. I don't know what to do.

It sounds like you are going to have to decline to be executor of your grandfather's will, and that someone else will have to take on the job...or in the alternative, hire a PI to find your uncle.

If one subject to an inheritance cannot be located, court will eventually approve actions necessary by the executrix to complete the probate in a manner such that the inheritor's portion is held in a manner that will allow it to eventually default to the states unclaimed funds department.

This is true. Basically the funds would be held in escrow. The executor would have to make a good faith effort to find the heir, but that would not hold up distribution to other heirs. I also agree that a "good faith effort" is unlikely to require the executor to travel to a foreign country.
