MY BROTHER DIED INTESTATE AND HAD A SMALL BUSINESS IN WHICH HE RENTED THE PREMISES ON A MONTH TO MONTH VERBAL LEASE. THE LANDLORD WANTED US TO MOVE HIS BUSINESS OUT 2 DAYS AFTER HE DIED. AN ATTORNEY TOLD US HE HAD TO GO THROUGH THE LEGAL PROCEEDINGS OF EVICTION. WE RECEIVED A LETTER DATED JUNE 6TH FROM THE LANDLORDS ATTORNEY ORDERING US TO VACATE WITHIN 30 DAYS OR THEY WOULD REMOVE THE BUSINESS AND STORE AT THE ESTATES EXPENSE. THE ESTATE HAS NOT BEEN OPENED YET BECAUSE MY NEPHEW (22 YRS. OLD & THE SON OF THE DECEASED) HAS NOT YET OBTAINED LETTER OF OFFICE BECAUSE THESE THINGS TAKE TIME. WE WENT TO THE BUSINESS AND CHANGED THE LOCKS. WE COULD NOT CHANGE LOCKS ON THE MAIN DOOR BUT WE DID SECURE THE DOORS TO THE BUSINESS. ON JULY 1ST WE WENT BACK TO THE BUSINESS AND THE MAIN DOORS WERE LOCKED. THERE HAS BEEN NO EVICTION PAPERS SERVED TO US, PLUS WE WERE NOT EVEN GIVEN A FULL 30 DAYS. IN THE MEANTIME AN EMPLOYEE OF MY BROTHERS HAS OPENED HIS OWN BUSINESS IN THE SAME PLACE AND WE HAVE NO IDEA WHERE MY BROTHERS PROPERTY IS OR IF IT IS BEING USED BY THIS EMPLOYEE. CAN THE LANDLORD AND EMPLOYEE DO THIS LEGALLY? IF NOT, WHAT MEASURES CAN WE TAKE AGAINST THEM?
