What is the name of your state (only U.S. law)? California

We have been working without a contract for a month and 2 days. Negotiations are only held two or three days a week. The company, publicly say they are willing to meet 24/7. They only talk with the union about 30 to 40 mins. when they do meet. They only talk about minor issues, never about issues that may bring on a strike. It seems thay are stalling. Why would they want to stall? Can we call for a 2 day strike just to get their attn? Maybe the "blue flu"?

Not a very good idea. If you did not go out on strike upon the expiration of the previous contract, you are likely still working under the previous contract, it has just been extended till an agreement can be reached. An organized work stoppage without the union backing will result in harsher disciplinary actions. Or the company can claim the employees are not working under a contract and fire those that participate then refuse to deal with the union over the lost jobs.

Don't do anything unless the union supports it.

Racer you are right we are working under our previous contract, which had a no strike clause as well as a no lockout clause. They are no longer in effect according to our union lawyer. We also loose our arbatration rights?
Why would they want to stall? Mybe we should try to get the unions backing on the "blue flu" idea. An union rep said today that we would have to give the company 48hr. notice if we call for a two day strike. Are there state laws pretaining CBA negotiations? The union is also saying that if the company locks us out then we can get unemployment?
