Please suggest a direction-My children were (one still is) members of an athletic sports team. In 2005 I took the original logo and recreated it to update the artwork. I changed, adjusted and updated the starting from scratch but basing the new off the old logo.
NOW: I was approached by a parent and rowers in the spring who wanted a large (20x30) varsity team poster based on other team concepts in the area. I secured security clearance and wrangled the teens into one spot in front of a Air National Guard Helicopter. A photographer took the photo and gave me permission to use it in the poster. I designed the poster to reflect the teams desire. MEAN and GREEN is the title. included is the team logo which I designed, the team website address, and the team name.
I provided the art to the club board for a decision on financing for the poster in May. Options given: let each rower sell 2 to food establishments in the area for profit, I pay for production and then recoup the money in sales, or the board pays for production to recoup expenses.
The boards administration changed at the end of the spring season. So the board that originally implied permission for the poster are now no longer on the board. The current board has done nothing with the poster. In an effort to provide the rowers that posed for the photo with the completed poster we decided to send out an email with a poster flyer stating that we were going to produce the poster and all proceeds would be donated back to the club minus the production of a framed copy to the Air National Guard unit that provided the helicopter.
I sent an email to everyone on the club, parents, rowers, and the club board with the flyer. I almost immediatly received an email from the club board stating that I am not allowed to produce the poster (which they had nothing to do with), I am not allowed to use the logo (which I designed), and I am not allowed to use the club emails (which other parents and I have collected over the years). The next day I started receiving checks from parents and kids for poster orders.
What am I allowed to do?
Options-Produce the poster anyway? Produce the poster with changes ie Remove the logo, name and website and produce the poster? (will I need to remove each logo on the athletes uniforms?) Destroy the poster and send everyone their check back?
