What is the name of your state?TX
I Have a friend that has a 4 year old child who's mother accused him of 'messing around' with his child. DHS is involved now and states that they need him to do a poligraph. This situation has just started in the last week. DHS has not interviewed my friend in regards to the accusations.

Is it normal for a poligraph to been done in this type of situation?
Is it recommended to not take a poligraph?

All family services offices will ask for a suspect to take a polygraph. Myself and my fiancee were asked if we would take one because we are under investigation for felony child abuse and neglect (I have a thread up.. that will give you more details on the situation if you care to know)...

Anyways, the best thing he could do is if he has nothing to hide, do exactly what we did and agree to it. They asked us about a month and a half ago and we said we would, and they havnt said another thing about it. I dont know if they can even legally give one, and if they can, I dont know if it would hold up in court ( because I know a lot of states wont accept it as evidence) and they are so unconclusive that it doesnt matter.

I'd say if he has nothing to hide, tell him to agree... I think thats the states way of trying to scare you because a lot of people dont know that they cant be used in court... if someone says they wont take one and doesnt have a real reason (as in medical reason, high blood pressure etc) not to take one than they are pretty much saying they are scared and have something to hide. If he has nothing to hide, he should have no problem taking one.

This just happened to my sister and nephew. My nephews ex falsely accused both of them of molesting the children, just because she felt the kids were getting too close to them. After an investigation and several trips to court, they were cleared of all of it. He had supervised visits (by his SIL) during the investigation, which lasted about 4 months, but now he has been granted sole custody. The judge also ruled that if his ex makes any further accusations at all, SHE has to pay all legal fees for his defense. I guess judges are starting to get wise to all the false accusations made by disgruntled exes. About time!

Hire a good attorney and fight it. This is the most heinous of false accusations. Don't let her get away with it. After you win in criminal court, sue her in a civil trial for return of the cost of all your legal fees, any other expenses you incurred and emotional damage to you and your children. You can use the very report from the investigation, the psychologists, etc. against HER! It will probably be a long hard fight, but should come out in your favor if you are innocent.
Make sure your attorney places sanctions for any possible future problems when you win the case, and file for sole custody.
