Hi everyone of legal knowledge. I am just wondering whether any of you has the advice I need concerning my Prop. 36 drug offender case. I am finished with my 1 year of program, and am almost done with the "aftercare" portion, at which point I will be allowed to petition for dismissal of my case. They said I should use an attorney, but my case originated very far away, and I would rather not blow my savings on another one.
My question is this: does anyone know if it is possible/ permitted for the defendant himself (ME) to fill out and file the proper form petitioning the court for dismissal/ expungement of all charges? If so, does the court frown on this way of doing it, and thus less likely to grant the dismissal/expungement? I would really like to do this myself --with the proper forms, at the courthouse-- but only if it is feasible to do so. If anyone out there knows the best course of action for me, that would be great! I live in Oakland, Alameda County, and would love to finally put my drug arrest behind me, without wasting hard-earned cash on an attorney if I don't even really need one, you know?
