Hi everyone of legal knowledge. I am just wondering whether any of you has the advice I need concerning my Prop. 36 drug offender case. I am finished with my 1 year of program, and am almost done with the "aftercare" portion, at which point I will be allowed to petition for dismissal of my case. They said I should use an attorney, but my case originated very far away, and I would rather not blow my savings on another one.
My question is this: does anyone know if it is possible/ permitted for the defendant himself (ME) to fill out and file the proper form petitioning the court for dismissal/ expungement of all charges? If so, does the court frown on this way of doing it, and thus less likely to grant the dismissal/expungement? I would really like to do this myself --with the proper forms, at the courthouse-- but only if it is feasible to do so. If anyone out there knows the best course of action for me, that would be great! I live in Oakland, Alameda County, have been clean and sober for over 500 days now, and would love to finally put my drug arrest behind me --without wasting hard-earned cash on an attorney if I don't even really need one, you know?

Think of it this way ... if you do it wrong, the arrest will remain and you may never get full credit for the program. Is it worth taking that chance?

It's likely you can do it yourself, but unless you can get some guidance through the court, I'd go for the attorney. This is too important to leave to amateurs (i.e. yourself).
