Looking for someone w/experience in Illinois college support laws

SD is graduating from high school in June. CP wants college support. We are offering 1/3 of tuition, fees and books, with CP and child also contributing 1/3 each. (This will not be a lot of money for any of us.) We're quite sure that CP will reject this offer, because she's used to getting more than $1000.00 per month in child support for one child and doesn't want to give that up. She's citing "living expenses" as an excuse for more money. (Child will live at home and attend community college.) I'm very familiar with all of the Illinois CS Statutes, as well as some case law. I do know that there are provisions for living expenses, but need to know how they are generally calculated.

Does anyone have any experience with this?

It states clearly that child support ends upon graduation from high school (Thank God it says this), and that each parent will "contribute to college expenses based on their ability to pay and the child's aptitude and desire for higher learning."

I was actually hoping to find someone here who's gone through this experience in Illinois, so that I might get some further insight as to the current trends in this area of CS law. I know that a lot of this will be left up the the judge's discretion.

O.K. then you tell me what 'someone else going through this...' has to do with your husband's exact legal situation regarding the support order and it's specific language, the financial circumstances of each party to the order and the specific circumstances of the order pertaining to any future legal action?

Current rulings that might have similar circumstances...

Well.... SD apparently has two parents. That's the only "we" involved in any sort of legal discussions regarding SD.

The word "we" does not exist in any of my posts... Are you implying that I have no right to be making this inquiry based on the fact that I am merely a step-parent?

Looks like a "we" to me. You said she is used to $1000 a month in child support. For her that is income and maybe without that income she will not be as able to meet the expenses as her ex husband is.

Also maybe she feel that the cost to her to give the child a place to live while in school is "living expenses." What you are going to have to do is let a judge decide who is capable of paying what based on the income all both parents.

Thank you keyzblewz - I was just about to do the same. Sure you have a right to inquire about things, SoSickOfIt. But you have no place in any of the legalities.
