My last paycheck had a wage garnishment for a case I was never aware of. I was never served, never notified by the attorney of the credit card company, and my employer never notified me - they just garnished my check. The order was entered April 2004. I was unemployed until 3 weeks ago, Sep. 2004. I'm filing a motion to vacate judgement, declaring the aforementioned. My question is: The only form I can find for "motion to Vacate Judgement (Form SC-135) says "Small Claims". The amount the judgement was for is $5,500.
Can I still take this to court if it's passed 30 days?
Is there another motion to vacate judgement form, for limited civil judgements? I'd appreciate any help at all. I'm a school teacher, single mom with 3 kids and my 1st check had a big chunk taken out of it!
