losing my cool

i purchased a newly built home that is now 1 year & 2 months old. I did not have central ac installed because it was extra. i realized i could not control the thermostat and someone was sent out to correct this (covered under warranty). he did not understand why i was receiving heat since the wires were not connected to the furnace. he hooked up the wires and said "i will hook up the air conditioner wires also. give us a call when you are ready to install". I called a reputable store when i was ready to buy and when they went to turn the system on, the transformer blew. i was told the color coding had been changed (the wires were installed incorrectly). the warranty will not cover this because another company had touched the system and i can not prove misconduct on their part. am i out of money for this????? help!!

If you get a statement from the reputable store that the wires were installed incorrectly, and that that caused the damage, that would be evidence against the company of the person who hooked up the wires for you. They were negligent, and they are legally responsible to reimburse you for your loss due to their negligence.

In a case where the color codes are changed, I believe negligence is clear.

So the first thing to do is contact the company that did the work and notify them of your damage and tell them how it happened. Then ask them what they will do.

If they don’t satisfy you, you could either have a lawyer write them a letter or go to small claims court. You should win in small claims.
