What is the name of your state? Ohio
I am currently in the process of both loss mitigation and pending foreclosure on my home. I received the first notification for a court case. In the meantime however, before the notification came, I had already starting sending the needed documents to loss mitigation to try and work on a partial claim. I knew they needed time but after a month (given the christmas and new year's break) I called them to get the status of my file.
Well, although the person found the documents I had faxed, she could not find my file and promised that she would call me when she found it. It's been 1 1/2 weeks so far and I am about to call back again, but in the meantime there's still the threat of foreclosure hanging over my head and so is it possible that if loss mitigation does not find my file, the loan company will go ahead and foreclose anyway? Is there anything I can do in this matter to help loss mitigation move faster and find my file?
Thanks

Assuming it is an FHA loan, the lender MUST review a Loss Mitigation option prior to foreclosing. You may or may not qualify for the partial claim. My advice, re-send anything that thay may need and be the squeeky wheel...
