I was recently laid off from my job and I can no longer pay my rent. Is there a provision in the Texas Landlord Tenant Act that prevents me from having to pay the penalties of breaking a lease due to unemployment?

I realize that you've lost your job, but why shouldn't you be bound by the terms of your lease?

Simple answer... no.
Your landlord is still obligated to pay the mortgage (if one) on the property that you are living in. Do you really think that there would be a law that allows anyone who becomes unemployed (fault or no fault) to simply walk from their lease??

In Alaska where I rented before there is that very provision so that if you are forced to move out because you have been laid off, you wont be hit with huge fees on top of being let go.

Are you getting unemployment? Have you considered getting a roommate for a while, if LL agrees?

I was laid of for six months, several years ago and never missed a payment. Being unemployed, especially very recently unemployed, is no excuse. One is supposed to plan for periods of lack of income and spend accordingly.

There is no such provision in Alaska statutes. I reviewed them (Chapter 34.03) which can be found online at:

And even if it was accurate, last time I checked, Alaska laws have nothing to do with where the OP is located (Texas)!!
